1. General information

This document, together with others mentioned in it, regulates the conditions for the use of this website (www.vinitrading.es) and the purchase or acquisition of products and/or services on it (hereinafter, "Conditions"). By using this website, or by requesting the acquisition of products and/or services through it, the User agrees to be bound by these Conditions. If you do not agree with them, you should not use this website.
The activity developed through vinitrading.es includes:
- Batteries and chargers
- Consumer electronics
- LED lighting
- Flash drives
The User must have read the Legal Notice, the General Conditions of Use, the cookie policy, and the privacy policy of Vini Trading before accessing, browsing and using this website.
2. The user
Access, navigation and use of vinitrading.es grants the status of user (hereinafter "User"), which implies acceptance of all the Conditions and their future modifications. The User agrees to use miweb.es only to make legally valid inquiries and purchases and to provide truthful contact information.
The User declares to be over 18 years of age and to have the legal capacity to enter into contracts. This page is primarily aimed at Users residing in Spain, and Vini Trading does not guarantee that it complies with the laws of other countries.
3. Purchase or acquisition process
Duly registered Users can purchase through the means established on vinitrading.es, following the online purchase procedure. The User must confirm his order by clicking on "FINALIZE ORDER". He will then receive a confirmation email and notification of shipment.
Once the purchase process is complete, an electronic invoice will be generated and sent to the User's email. The User may also request a paper copy.
4. Availability
All orders are subject to product availability. In the event of a stock shortage or circumstances of force majeure, Vini Trading undertakes to notify the User and refund any amount paid.
5. Prices and payment
Prices on vinitrading.es are final, in Euros (€) and include applicable taxes, unless otherwise indicated. No additional costs will be added to the price of a product automatically, only those that the User has voluntarily selected. Payment can be made by the methods indicated on the Payment Methods page.
Vini Trading uses the secure SSL payment system to ensure the confidentiality of payment data. Orders paid by bank transfer will be reserved for 5 calendar days.
6. Delivery
Delivery will be made within Spain (including the Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla) and other destinations in the European Union. In the event of delivery being impossible, Vini Trading will contact the User, who may choose to continue with the purchase by establishing a new delivery date. In any case, home deliveries are made on working days.
If delivery is not made due to the User's absence, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is and how to have it delivered again.
If the User is not going to be at the delivery location during the agreed time slot, he/she must contact Vini Trading to arrange delivery on another day.
If 30 days have passed since the order was available for delivery, and it has not been delivered for reasons not attributable to Vini Trading, it will be understood that the User wishes to withdraw from the contract, and payments will be refunded except for additional costs. The User must bear in mind that the transport resulting from the termination may have an additional cost that may be passed on to him.
For the purposes of these Conditions, delivery shall be deemed to have taken place or the order to have been delivered at the time when the User or a third party indicated by the User acquires material possession of the products, which shall be accredited by the signature of receipt of the order at the agreed delivery address.
Any risks that may arise from the products will be borne by the User from the moment of delivery. The User acquires ownership of the products when Vini Trading receives full payment of all amounts due in relation to the purchase or acquisition made, including shipping costs, or at the time of delivery, if this takes place at a time after the full receipt of the amount to be paid by Vini Trading.
In accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax (VAT), purchase orders for delivery and/or provision will be deemed to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at any given time depending on the specific item in question.
In this same sense, and in accordance with Chapter I 0883/110 relating to the common VAT system, purchase orders will be located, for their delivery and/or provision, in that Member State of the European Union where the address that appears in the purchase order is located and, therefore, the applicable VAT will be that in force in said Member State.
For orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT pursuant to the provisions of Eap 88/1330, 0883/110, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories. The User must bear in mind that in these territories there may be situations in which taxes and customs duties are applied and accrued at destination, in accordance with current regulations, and that these may be borne by the User.
For the rest of the locations, other than those mentioned above, where the purchase orders will be located, the regulations in force at any given time will apply for their delivery and/or provision; the User must take into account that this could generate the application and accrual of taxes and customs duties at the destination, in accordance with the regulations in force at the destination, and that these could be borne by the User. For further information, the User must contact the customs office at the destination.
7. Technical means to correct errors
The User may correct any errors entered in the data before clicking on "FINALIZE ORDER". The User may also contact Vini Trading to correct any errors using the contact details provided.

8. Returns
Right of Withdrawal:
The User who makes a purchase on vinitrading.es has the right to withdraw from the purchase within a period of 14 calendar days from when the User or an authorized third party acquires physical possession of the goods. This right can be exercised without the need for justification.
To exercise the right to withdraw, the User must notify Vini Trading of his/her decision clearly and unambiguously by means of the contact methods available on the site or by means of a letter to the Withdrawal and Data Rectification Department . You can also use a form provided by the company, although this is not mandatory.
In the event of withdrawal, Vini Trading will refund all payments, including shipping costs (except for additional costs arising from special shipments) within 14 days from the date the company was informed of the decision. The refund will be made using the same payment method used by the User, but Vini Trading may retain it until receiving the goods or proof of return.
The User must return the products without delay, no later than 14 days from the date of notification of withdrawal. In addition, the User assumes the cost of the return, unless the company indicates otherwise. The User will be responsible for any damage or loss of value to the products due to incorrect use. There are exceptions to the right of withdrawal, such as personalized products, goods that deteriorate quickly, or products that have been unsealed and cannot be returned for reasons of hygiene or health.
Return of defective products or shipping errors:
If the User considers that a product is defective or that there was an error in shipping, he/she must immediately notify Vini Trading . The company will inform about the return process and the item will be examined. If the defect or error is confirmed, a refund or replacement will be made within 14 days of confirmation.
The refund will include all costs, including shipping. If the User purchases third-party products through vinitrading.es , he/she may also contact the manufacturer directly to exercise the legal guarantee.
Warranties:
The User, as a consumer and user, enjoys guarantees on the products that he/she may purchase through vinitrading.es, in the terms legally established for each type of product, Vini Trading being responsible, therefore, for any lack of conformity thereof that becomes apparent within a period of two years from the delivery of the product.
In this sense, it is understood that the products comply with the contract provided that: they fit the description made by Vini Trading and possess the qualities presented therein, in addition to being suitable for use and presenting the usual quality and performance. When this is not the case with respect to the products delivered to the User, the latter must proceed as indicated in the section After-sales management of defective products. However, some of the products sold on vinitrading.es may present non-homogeneous characteristics provided that these derive from the type of material with which they have been manufactured, and which will therefore form part of the individual appearance of the product, and will not be a defect.
On the other hand, it may be the case that the User purchases a product from a brand or manufactured by a third party on vinitrading.es. In this case, and considering the User that it is a defective product, he/she also has the possibility of contacting the brand or manufacturer responsible for the product to find out how to exercise his/her legal warranty right directly against them during the two years following the delivery of said products. To do so, the User must have kept all the information regarding the product warranty. 9. Reservation of ownership
Until the customer has made full payment for the purchased products, Vini Trading retains ownership of the same. In the event that the customer's goods are seized before full payment for the products has been made, the customer is obliged to expressly indicate in the seizure notice that said goods remain the property of Vini Trading.
In the event that, despite this warning, the products are seized, the customer must facilitate Vini Trading's exercise of a third-party claim , which is the legal procedure to claim ownership of the seized goods. All expenses arising from this procedure will be borne by the customer, who will be responsible for the necessary steps to defend the interests of Vini Trading .
Furthermore, the customer is not only responsible for fulfilling his obligations regarding payment for the purchased products, but is liable for these obligations with all his assets , not just the products he has purchased. This includes any present or future assets that the customer owns, which reinforces the customer's commitment to comply with all the conditions agreed upon in the purchase.
These provisions are essential to ensure compliance with contractual obligations and protect the interests of Vini Trading until full payment for the products has been completed.
10. Disclaimer of liability
Vini Trading will not be liable for any loss or damage not attributable to a breach on its part, nor for business or indirect losses that were not reasonably foreseeable at the time of entering into the contract. Nor will it be liable for slight differences in the display of the product due to screen resolution or browser problems, nor for delays or problems arising from transport or external causes such as strikes, roadblocks, and in general any other causes inherent to the sector, which result in delays, loss or theft of the product.
Furthermore, Vini Trading is not responsible for technical failures of the service, lack of availability of the website, or for reasons of force majeure. The company will not assume responsibility for misuse of the products or incorrect returns by the User.
11. Written communications and notifications
The User accepts that most communications with Vini Trading will be electronic (email or notices posted on vinitrading.es). Therefore, for contractual purposes, the User agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information and other communications that Vini Trading sends electronically comply with the legal requirements of being in writing. This condition will not affect the rights recognized by law to the User.
The User may send notifications and/or communicate with Vini Trading through the contact details provided in these Conditions and, where applicable, through the contact spaces on vinitrading.es.
Likewise, unless otherwise stipulated, Vini Trading may contact and/or notify the User by email or at the postal address provided.
12. Resignation
Vini Trading 's failure to enforce any right shall not constitute a waiver of any other rights arising from these terms and conditions. Any waiver must be made in writing to be effective.
13. Partial nullity
If any provision of these Conditions is declared void by a competent authority, the remaining clauses will remain valid.
14. Complete Agreement
These Conditions constitute the entire agreement between the User and Vini Trading in relation to the purchase and sale of products.
15. Data protection
Personal data provided during the purchasing process will be treated in accordance with the data protection policies established on the site.
16. Conflict resolution
Access to and use of the website shall be governed by Spanish law. Any dispute relating to these Terms shall be subject to the jurisdiction of the Spanish courts.
17. Complaints and claims
The User can send complaints or claims through the contact means provided by Vini Trading .
Vini Trading has official complaint forms available to consumers and users, which they can request from Vini Trading at any time, using the contact information provided at the beginning of these Conditions (General Information).
You may also request an out-of-court dispute resolution, in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC through the European Union platform .
